Gift cards

1. Who issues these cards

Minis N Maps promotional gift cards ("Cards") are issued by JWAL Software LLC, a Utah limited liability company doing business as Minis N Maps ("we," "us," "our"). By accepting, holding, or using a Card, you agree to these Terms and Conditions ("Terms").

2. What a Card is

Cards are issued at no charge, as prizes, awards, or promotional items. No money or other consideration is paid by any recipient in exchange for a Card. We do not sell Cards.

A Card is prepaid promotional merchandise credit, redeemable only for goods and services we sell. A Card is not a credit card, charge card, debit card, bank account, or deposit account. It is not insured by the FDIC or any other agency, and it earns no interest. No part of a Card balance is a claim against us other than the right to redeem it for merchandise as described in these Terms.

3. Where and how you can use a Card

Cards are redeemable only for merchandise from Minis N Maps, at minisnmaps.com and at any Minis N Maps retail location. Cards are not redeemable at any other merchant, marketplace, or platform.

To redeem, present the Card or enter the Card code at checkout.

You may apply a Card balance to merchandise. Cards do not cover shipping charges or, where we are required to collect it, sales tax — those are paid by another accepted payment method. You may use more than one Card in a single transaction. If your purchase costs more than the Card balance, you pay the difference by another accepted payment method. If your purchase costs less, the remaining balance stays on the Card for next time.

Cards may not be used to buy other gift cards, or applied to preorder deposits, layaway, consignment items, or event or tournament entry fees.

4. No expiration date and no fees

Card balances do not expire. There is no expiration date on any Card we issue.

We charge no fees of any kind in connection with a Card — no activation fee, dormancy fee, inactivity fee, service fee, maintenance fee, replacement fee, or balance inquiry fee.

5. Cash redemption

Cards are not redeemable for cash except where required by law. We will redeem a Card for cash where, and only to the extent that, applicable law requires cash redemption of a Card balance. Cards have no cash value except as stated in this section.

6. Checking your balance

To check a Card balance, email info@minisnmaps.com or ask at the register. Balance inquiries are free.

7. Treat the Card like cash

You bear the entire risk of loss, theft, damage, or unauthorized use of a Card. Treat a Card like cash. We are not responsible for and will not replace a Card that is lost, stolen, damaged, destroyed, or used without your permission, and we are not responsible for a Card code that you disclose or that a third party obtains.

8. Not for resale

Cards are not for resale. You may not sell, auction, barter, or offer a Card for value on any secondary market, marketplace, exchange, or resale platform. You may give a Card to another person as a gift; that person is then subject to these Terms.

We may, at our discretion, void a Card and decline to honor its balance if we determine it was offered or sold for value in violation of this section, obtained through fraud or theft, or acquired in any other unauthorized way.

9. Returning merchandise bought with a Card

If you return merchandise you purchased with a Card, the refund is issued as Card credit, up to the amount originally paid with a Card. Any remainder is refunded to the other payment method you used. A return will not produce a cash refund of Card value, unless applicable law requires otherwise.

10. Fraud and unauthorized use

Fraudulent acquisition or use of a Card — including obtaining Card codes from unissued or unactivated cards — may violate Utah and federal law and may be reported to law enforcement.

We may suspend, freeze, or void a Card, or decline a redemption, if we reasonably suspect fraud, theft, tampering, unauthorized acquisition, or a violation of these Terms, or if the law requires it. If we do so in error, we will restore the balance.

11. How Cards are awarded, and taxes

Cards are awarded as prizes or promotional items, at our discretion or under the published rules of a contest, tournament, drawing, or promotion. Eligibility, selection of winners, and the rules of any promotion are governed by that promotion's official rules, not by these Terms. Where we provide Cards to another organization as prize support, that organization — not us — is responsible for running the promotion and for any tax reporting to winners.

Any tax arising from your receipt of a Card as a prize is your responsibility.

12. Limitation of liability

Our total liability to you in connection with a Card is limited to the unused balance on that Card. To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to a Card, including any inability to use a Card.

Nothing in these Terms limits any right you have under applicable law that cannot be waived, and nothing here excludes liability for our own fraud.

13. Changes to these Terms

We may change these Terms from time to time. Changes will not reduce the unused balance of any Card issued before the change, and will not add an expiration date or a fee to a Card issued before the change. The current Terms are always posted at minisnmaps.com/gift-cards.

14. If we close

If we cease retail operations, we will:

• post notice at minisnmaps.com and, if we still have a shop open, at the shop, at least thirty (30) days before we stop honoring Cards;
• keep honoring Cards in full for merchandise throughout that period, to the extent we have merchandise available; and
• where practicable, provide a way to redeem Card balances during that period, which may include in-store redemption, online orders, or redemption during a closing sale.

After the notice period ends, Cards are no longer redeemable.

15. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or relating to a Card or these Terms will be brought exclusively in the state or federal courts located in Davis County, Utah, and you consent to the jurisdiction of those courts.

16. General

If any provision of these Terms is held unenforceable, the rest stay in effect. If we don't enforce a provision, that isn't a waiver of it. These Terms are the entire agreement between you and us regarding Cards.
